CHILDCARE PHOTOGRAPHY

These Terms & Conditions apply to childcare photography services provided by Lisa J Photography to parents and legal guardians of participating children. By registering a child for childcare photography and paying the required photography credit, the parent or legal guardian confirms that they have read and accepted these Terms & Conditions.  

1. Registration & Consent 1.1 Each child must be registered through the designated online registration form before participating in photography.

1.2 The person completing the registration must be the child's parent, legal guardian or otherwise authorised to provide consent for the child to be photographed.

1.3 The registration form will collect information necessary to provide the photography service, including parent/guardian contact details, child information and relevant consent.

1.4 Photography consent applies to the child's participation in the childcare photography service and does not automatically constitute consent for Lisa J Photography to use the child's images for advertising, social media, website, portfolio or other promotional purposes. Any promotional image consent will be requested separately where applicable.

1.5 Parents/legal guardians are responsible for ensuring that information supplied during registration is accurate and current.  

2. Photography Day

2.1 Photography will take place on the date or dates arranged with the childcare centre.

2.2 Each registered child will be photographed in a relaxed and child-friendly manner.

2.3 Lisa J Photography aims to provide approximately 10–15 photographs per child, however this is an approximate guide and is not a guaranteed number of images. 2.4 The number and variety of photographs captured may vary depending on the child's participation, mood, age, cooperation, health, available time, childcare activities, lighting, weather and available locations.

2.5 Photography locations may include indoor and outdoor areas of the childcare centre and may vary throughout the photography day.

2.6 Lisa J Photography may adapt the photography approach, location and style to suit the child and conditions on the day. 2.7 Where a child does not wish to participate, becomes distressed or cannot reasonably be photographed, Lisa J Photography will not force the child to participate.  

3. Photography Style

3.1 The current photography style focuses on natural, relaxed and outdoor portraits, together with gently posed portraits where appropriate.

3.2 Traditional studio-style portraits may be provided where suitable facilities and arrangements are available at the childcare centre.

3.3 Parents acknowledge that photography is an artistic service and that individual images will vary according to the child, environment and conditions.  

4. $50 Photography Credit

4.1 A $50 photography credit is required before photography day to secure the child's place.

4.2 The $50 photography credit is non-refundable.

4.3 The full $50 credit is redeemable against photographs purchased from the child's childcare photography gallery. The credit must be used while the gallery is available and expires when the gallery closes.

4.4 The photography credit is not an additional session fee.

4.5 The credit cannot be exchanged for cash or transferred to another child or photography session unless agreed by Lisa J Photography.

4.6 If a child does not participate in photography for reasons outside Lisa J Photography's control, the $50 credit remains non-refundable but may be applied to photographs if a suitable replacement photography opportunity is arranged.

4.7 If Lisa J Photography is unable to provide the photography service and no alternative photography opportunity can reasonably be arranged, the applicable credit will be addressed with the parent/guardian on a case-by-case basis.  

5. Photograph Collections & Pricing The available digital collections are:

Little Moments — $50 3 professionally edited digital images.

Growing Memories — $79 6 professionally edited digital images.

The Complete Story — $100 The complete gallery of approximately 10–15 professionally edited digital images.

5.1 Prices are current at the time of photography and may be subject to change for future photography sessions.

5.2 The parent/guardian may use their $50 photography credit toward any available collection.

5.3 Additional digital images may be purchased for $15 per image, where the selected collection does not already include the complete gallery.

5.4 Prints, wall art and other products may be offered as optional purchases and will be subject to the prices displayed at the time of ordering.  

6. Online Galleries

6.1 Following professional editing, photographs will be made available through a private, password-protected online gallery.

6.2 Gallery access details will be provided to the registered parent/guardian or authorised person.

6.3 Parents/guardians are responsible for keeping their gallery access details secure and must not publicly share passwords or private gallery links.

6.4 The gallery will generally remain available for approximately three months following delivery. 6.5 Lisa J Photography may remove galleries earlier or extend the gallery period where circumstances require.

6.6 Parents/guardians are responsible for selecting and purchasing their photographs within the gallery availability period.  

7. Digital Photograph Delivery

7.1 Purchased digital photographs will be provided through the secure online gallery for download.

7.2 Images will be professionally edited by Lisa J Photography.

7.3 Digital files are supplied for personal use.

7.4 Parents/guardians are responsible for downloading and safely storing purchased digital photographs.

7.5 Lisa J Photography recommends maintaining a backup of all purchased digital files.

7.6 Once the applicable image retention period has ended and images have been permanently deleted, Lisa J Photography cannot guarantee that photographs can be recovered or re-supplied.  

8. Image Storage & Deletion

8.1 Captured photographs are stored securely using password-protected storage while photographs are being processed and made available for viewing and purchase.

8.2 Photographs will generally be retained for approximately three months following delivery of the online gallery.

8.3 Following the retention period, captured photographs and associated working files will be permanently deleted from Lisa J Photography's working storage systems, subject to any files that are lawfully required to be retained or separately authorised for ongoing use.

8.4 Parents/guardians should ensure that all purchased photographs are downloaded before the gallery and image retention period expires.  

9. Absence & Missed Photography

9.1 If a child is absent on the scheduled photography day, Lisa J Photography will, where reasonably possible, return to the centre within the following 1–2 weeks.

9.2 A return visit is subject to Lisa J Photography's availability and arrangements with the childcare centre.

9.3 A return visit cannot be guaranteed. 9.4 If a return visit cannot be accommodated, Lisa J Photography will contact the parent/guardian regarding the available options.  

10. Weather & Centre Conditions

10.1 Photography locations and photographic style may change due to weather, lighting, safety considerations, centre activities or available facilities.

10.2 Outdoor photography may be moved indoors where weather or conditions make outdoor photography unsuitable.

10.3 Lisa J Photography reserves the right to alter the photography setup where reasonably necessary to protect the safety and well being of children, staff and the photographer.  

11. Child Safety & Participation

11.1 The safety and well being of children is the priority during photography.

11.2 Lisa J Photography will not require a child to participate in a photograph if the child is distressed, unwilling or unable to safely participate.

11.3 Photography will be conducted in accordance with the arrangements and requirements of the childcare centre.

11.4 Lisa J Photography holds a current NSW Working with Children Check.  

12. Sibling & Group Photographs

12.1 Sibling photographs may be available where siblings attend the same childcare centre and appropriate permissions have been obtained.

12.2 Class and group photographs may be arranged in consultation with the childcare centre.

12.3 Additional sibling or group photographs requested by a parent/legal guardian are subject to the consent of all relevant children's parents/legal guardians and the arrangements of the childcare centre.  

13. Privacy & Confidentiality

13.1 Lisa J Photography will take reasonable steps to protect the privacy and security of children's photographs and personal information.

13.2 Private galleries are password protected.

13.3 Personal information collected through registration will be used for purposes associated with providing the photography service, including photography scheduling, communication, gallery delivery, ordering and payment.

13.4 Personal information will not knowingly be sold or provided to third parties for unrelated marketing purposes.

13.5 Any consent for Lisa J Photography to use photographs for promotional purposes will be obtained separately from the consent required to provide the childcare photography service.  

14. Image Copyright & Personal Use

14.1 Copyright in photographs remains with Lisa J Photography unless otherwise agreed in writing.

14.2 Purchasing digital photographs provides the purchaser with a license for personal, non-commercial use.

14.3 Purchased photographs may be printed and shared with family and friends for personal purposes.

14.4 Photographs must not be commercially reproduced, sold, altered for commercial purposes or used for advertising without written permission from Lisa J Photography.  

15. Photographer's Artistic Style

15.1 Parents/guardians acknowledge that photography involves creative and artistic decisions.

15.2 Lisa J Photography will make professional decisions regarding composition, lighting, posing, editing and image selection.

15.3 While every reasonable effort will be made to provide a varied gallery, specific poses, backgrounds, expressions or photographs cannot be guaranteed.  

16. Complaints & Concerns

16.1 Lisa J Photography values feedback and will make reasonable efforts to resolve concerns promptly and fairly.

16.2 Any concerns regarding photographs, orders or the photography service should be raised with Lisa J Photography as soon as reasonably possible.

16.3 Nothing in these Terms & Conditions is intended to exclude, restrict or modify any rights or remedies available to consumers under Australian Consumer Law.   17. Changes to These Terms Lisa J Photography may update these Terms & Conditions from time to time. The Terms & Conditions applicable to a photography booking will be those provided or made available to the parent/guardian at the time of registration.  

18. Acceptance By submitting the online registration form and paying the required $50 photography credit, the parent/guardian confirms that: They have read and understood these Terms & Conditions. They are authorised to provide consent for the child named in the registration. They consent to the child participating in the childcare photography service. They understand that the $50 photography credit is non-refundable. They understand that the $50 credit is redeemable against photographs purchased. They understand that photographs will be provided through a private, password-protected online gallery. They understand that photographs are retained for approximately three months before being permanently deleted, subject to the provisions outlined above. They understand that they are responsible for downloading and safely storing purchased digital photographs.
